At GENBIA we value the privacy of those who visit Genbia.com, contact us, or use our automation, messaging, and software engineering services. This policy describes what data we process, for what purposes, with whom we share it, and how you can exercise your rights, including requesting deletion.
1. Information we collect
We may collect, depending on context:
- Contact data: name, email address, phone number, messages sent via forms or email.
- Business information: company name, job title, industry, Meta Business Manager identifiers, WhatsApp Business Account (WABA), Facebook pages, or Instagram profiles linked to the project.
- Technical data: access tokens, application identifiers, webhook configurations, automation logs, delivery metrics, and errors.
- Site usage data: IP address, browser type, pages visited, and aggregated analytics events.
- Conversation content or events processed in integrations, only to the extent necessary to operate the service contracted by the client.
2. How we use information
- Respond to inquiries and manage commercial relationships.
- Configure, operate, and support automated workflows on WhatsApp, Facebook, Instagram, and other agreed platforms.
- Implement integrations with Meta APIs, n8n, CRM, ERP, and client tools.
- Develop and maintain contracted software, websites, and applications.
- Improve security, service quality, and compliance with Meta policies and applicable laws.
- Send operational communications or, with consent, relevant information about the service.
3. Role as implementation provider (Tech Provider)
When we act as an implementation provider or Tech Provider for a client, we process Platform Data and related data solely on behalf of the client and according to their instructions, for the purpose agreed in the project. We maintain data separation between clients and do not use that data for our own purposes other than the contracted service.
The client is responsible for informing their end users and obtaining the authorizations required by Meta and applicable law.
When the client uses our hosted WhatsApp CRM, messages, contacts, and account configuration data are processed in our systems on behalf of the client, with logical separation per client account.
4. Opt-in, opt-out, and messaging
In messaging projects, the client must obtain legally valid consent or opt-in before initiating commercial or automated conversations, and provide a clear and accessible opt-out mechanism.
GENBIA configures technical workflows that respect messaging windows, approved templates, and categories permitted by Meta. Upon block or unsubscribe requests, we deactivate the corresponding processing in our systems to the extent of our control.
5. Data sharing
We do not sell personal data. We may share information only when necessary:
- With Meta Platforms, Inc. and associated products, to activate and operate APIs authorized by the client.
- With infrastructure, hosting, analytics, or automation tool providers under confidentiality and limited processing agreements.
- With the project owner client, when we process data on their behalf.
- When required by law or a competent authority.
6. Security
- Restricted access to tokens and credentials based on operational need.
- Encrypted communications (HTTPS/TLS) on services under our deployment.
- Environment and workflow segmentation per client when the project requires it.
- Monitoring of quality and responsible use of messaging APIs.
7. Retention and deletion
We retain data for as long as necessary to fulfill the contract, legal obligations, or resolve disputes. When no longer needed, we delete or anonymize it according to our internal practices.

8. Data subject rights
Under applicable legislation (including Chilean personal data protection regulations), you may request access, rectification, cancellation, objection, or other measures regarding your data.
